These Terms and Conditions define the usage terms for the radio hosting services provided by RadioHosting.net.
TERMS AND CONDITIONS
Radio Hosting Services Agreement
RadioHosting.net (hereinafter referred to as the "Service Provider") provides radio hosting services under the following Terms and Conditions, which outline the terms of use for these services.
This agreement becomes valid upon the approval of the application and payment by the Customer (hereinafter referred to as the "User").
Article 1 – Purpose and Scope of the Agreement
This agreement sets forth the terms and conditions for the use of the radio hosting services provided by RadioHosting.net. The services consist of server hosting, bandwidth, support, and other related services necessary for radio broadcasting. The Customer requests these services in exchange for the specified fees.
Agreement Duration is determined based on the service period chosen by the Customer (monthly, yearly, etc.) and is valid for the period in which the payment is made. Upon the expiration of the agreement period, the service will terminate unless one of the parties requests an extension.
Article 2 – Service Provider's Obligations
- Service Delivery and Setup
The Service Provider will initiate the necessary procedures for setting up the service once the Customer's payment is confirmed. The setup process is typically completed within 48 hours after payment is made, via methods like credit card or wire transfer. However, this duration may be extended in case of system errors or missing information. - Data Security and Backup
The Service Provider takes the necessary measures to ensure data security. However, regular data backup services are not provided by the Service Provider. The Customer is responsible for regularly backing up their data to avoid data loss. Backup services may be offered as an additional service. - System Support
The Service Provider is responsible for ensuring the proper operation of the system. In case of any issues with the system, the Customer should submit a support request via the ticket system. Technical support is provided only for server and infrastructure issues. Services like backup or content management are not covered under technical support.
Article 3 – Customer's Obligations
- Prohibited Content
The Customer may not host any content that violates the laws of their country, is immoral, contains violence, hate speech, or infringes upon the rights of others. The Service Provider reserves the right to terminate the service if such content is detected. - Legal Responsibilities
The Customer must use the service solely for its intended purpose. RadioHosting.net only provides radio hosting services and the Customer takes full responsibility for all legal issues related to broadcasting and the content of the broadcasts. - Payments and Fees
The Customer is obligated to pay the specified fee for the services to RadioHosting.net on time. The service fees are to be paid based on the selected billing period (monthly/yearly). If payment is not made, the service may be suspended or terminated.
Article 4 – Service Usage and Limitations
- Broadcast Bandwidth
The Customer is subject to the bandwidth limits provided by RadioHosting.net. The bandwidth may increase based on the number of listeners and traffic. If the specified limits are exceeded, additional charges may apply. - Service Duration and Termination
The Customer must provide written notice of termination at least 30 days in advance before the end of the service period. In the case of termination, unused service fees will not be refunded. The Service Provider may terminate the service if the Customer breaches the terms of the agreement.
Article 5 – Data Transfer and Loss
- Data Transfer
RadioHosting.net may transfer the Customer's data to another platform upon request. However, the Service Provider accepts no responsibility for data loss, service interruptions, or disruptions that may occur during the transfer process. - Data Loss
Although RadioHosting.net takes necessary precautions to prevent data loss, it does not accept responsibility for any such loss. The Customer is responsible for minimizing the risk of data loss through regular backups.
Article 6 – Warranty and Liability
- Service Duration and Downtime
RadioHosting.net does not guarantee uninterrupted service. However, every effort is made to minimize downtime. Any downtime outside of planned maintenance will be notified by the Service Provider. - Damage and Liability
RadioHosting.net is not liable for any damages caused by system failures, maintenance, or other technical issues. The Customer is responsible for any third-party liability arising from the use of the service.
Article 7 – Breach of Agreement and Sanctions
- Service Cancellation
RadioHosting.net reserves the right to immediately cancel the service if the Customer violates this agreement, fails to make payments, or broadcasts illegal content. In such cases, no refunds will be issued. - Prohibited Content and Misuse
If the content hosted by the Customer is found to be in violation of the laws of the Customer's country, the content will be removed, and the Customer's access to the service will be terminated.
Article 8 – Privacy and Data Protection
- Data Security
RadioHosting.net is committed to maintaining the privacy and confidentiality of the Customer's personal data. This data will be used only for the purpose of providing services and will not be shared with third parties. - Backup and Protection
The Customer is responsible for taking necessary security measures to protect their data. RadioHosting.net will take reasonable measures to ensure data protection, but it does not guarantee protection against data loss.
Article 9 – Disputes and Legal Provisions
- Dispute Resolution
Any disputes arising from this agreement will initially be attempted to be resolved amicably between the parties. If a resolution is not reached, the dispute will be settled under the jurisdiction of the courts in your location. - Legal Provisions
This agreement is governed by the laws of the country in which the Service Provider operates. Both parties agree to resolve any disputes within the framework of applicable law.
Article 10 – Validity and Acceptance
This agreement becomes valid upon electronic approval by the Customer. The Customer acknowledges that they have read and accepted the terms and conditions of this agreement.
This agreement constitutes the legal framework for all agreements and services provided by RadioHosting.net.
